These terms and conditions (“Terms and Conditions”) of PRIHATIN Device Bundle Plan offered by speakOUT under Jaringan Prihatin Programme are as follows, which shall be read together with speakOUT Terms and Conditions (https://speakout.asia/terms) (“speakOUT Terms”). The speakOUT Terms forms an integral part of these Terms and Conditions.

General

1. The Jaringan Prihatin Programme is an initiative by the Government of Malaysia in collaboration with the telecommunication service providers whereby approximately RM2 billion is allocated for Malaysians who are eligible for Bantuan Prihatin Rakyat (“BPR”) to enjoy subsidy of certain telco packages.
2. All Malaysian citizens who are eligible in participating the Jaringan Prihatin Programme are eligible to apply for the speakOUT PRIHATIN Device Bundle Plan (collectively, “Eligible Individuals”) by completing the application form provided in https://speakout.asia/.

3. If you are an Eligible Individual with Child, whether married or single (“Child” in this context means individual under the age of 18 years), subscribing the speakOUT PRIHATIN Device Bundle Plan with Free Mobile Device and/or speakOUT PRIHATIN Data Plan, you are subject to the following terms: -

   • You are required to pay an upfront payment for the respective device plan and the speakOUT PRIHATIN Data Plan (“Upfront Payment”).
   • The amount of the Upfront Payment will be rebated into your speakOUT Airtime within 10 months period.
   • In the event where mobile number is suspended, terminated, or blacklisted, the remaining amount of the Upfront Payment will be forfeited.
   • In the event of change of account ownership, the remaining amount of the Upfront Payment will also be forfeited.
   
   

4. Under the speakOUT PRIHATIN Data Plan: -

   • A rebate of RM15 will be made into your speakOUT Airtime upon your renewal of your PRIHATIN Data Plan with us (“Rebate”), subject always that the renewal shall be for such plan and terms as we may prescribe. Such renewal shall be made before the end of the Jaringan Prihatin Programme on 31 July 2022 and your renewal is subject to a maximum period of 12 months.
   • In the event where mobile number is suspended, terminated, or blacklisted, the Rebate in your speakOUT Airtime shall be forfeited.
   
   
5. The device under speakOUT PRIHATIN Device Bundle Plan is supplied by a third party. speakOUT shall not be liable and disclaim any and all liability for the merchantability, quality, specifications and fitness of the device offered to you.
6. In the event of change of account ownership, speakOUT reserves the right to terminate your entitlement to the speakOUT PRIHATIN Device Bundle Plan and speakOUT PRIHATIN Data Plan.
7. speakOUT reserves the right to terminate your Jaringan Prihatin Programme registration with speakOUT if you fail to provide a valid national registration identity card and/or such other documents and information that speakOUT may prescribe.

Switch to speakOUT

1. The Mobile Numbers requested for porting by you must be in the range of the Mobile Numbers as approved by Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM) from time to time.
2. Only active Mobile Number shall be eligible for porting. Any mobile number or account which has suspended, terminated, blacklisted due to default of payment and/or barred are illegible for porting.
3. You must not have any outstanding bills or contract with your current servicer provider prior to your request for porting, failing which your request for Mobile Number Portability (“MNP”) may be interrupted.
4. MNP request may be subject to a non-refundable porting fee.
5. MNP is subject to existing geographic numbering requirements.
6. If you are the principal account holder, you are responsible to make sure there is no supplementary lines subscribed under your account prior to your request for porting.
7. You must make sure you are not the supplementary line holder prior to your request for porting.
8. You shall ensure the identification of national registration identity card provided to us is valid.
9. speakOUT shall not be responsible and/or liable for any interruption and/or delay in approving and/or providing our services to you for any reason caused/attributed by your existing network operator (“Donor Network Operator”).
10. speakOUT will not be responsible or liable for any unsuccessful or failure of your request to port to us. You confirm and acknowledge that your request for porting constitutes a notice to terminate your subscription with the Donor Network Operator.
11. You confirm and agree that all the services in connection to the mobile number provided by the Donor Network Operator, including value added services, rate plans, charges and fees will be terminated when the SIM Card of the Donor Network Operator is deactivated upon your successful porting to our network as the Recipient Network Operator (“RNO”). You acknowledge and accept that, any airtime balance you had with the Donor Network Operator will be forfeited and non-transferrable to the RNO. For the avoidance of doubt, speakOUT shall be in no way liable or responsible to you or any third party claiming through you for such forfeiture of any airtime balance and any losses or damage whether, direct, indirect special or consequential, or for loss of business, revenue or profits as a result of the porting.
12. You will be registered for Jaringan Prihatin Programme only upon successful activation of your mobile number with speakOUT.
13. Any device purchased from speakOUT under speakOUT PRIHATIN Device Bundle Plan will only be delivered upon successful activation of your mobile number with speakOUT.
14. speakOUT reserves the right to cancel your purchase of speakOUT PRIHATIN Device Bundle Plan if your request for MNP is rejected by the Donor Network Operator.
15. In the event of porting out of speakOUT, any remaining speakOUT PRIHATIN Device Bundle Plan related rebate will be forfeite
16. You expressly consented to speakOUT disclosing or processing your personal data in order to process and facilitate the porting.
